Proof of Service for an Eviction Notice: What Courts Actually Require

Published September 2026 8 min read

Most landlords prepare for an eviction hearing by assembling the ledger — the lease, the rent record, the texts where the tenant promised to catch up. Then the judge asks a narrower question, when and how did the tenant get the notice, and the case turns on a document nobody thought to bring. Unpaid rent is rarely the disputed fact. Delivery of the pre-suit notice very often is, and in several states you have to prove it in writing before the tenant says a word.

Two States Make You Plead It, Not Just Prove It

A distinction worth drawing early. In most jurisdictions, proof of delivery is evidence you produce if the tenant contests service. In Texas and California it is a required element of the paperwork that opens the case — a defect visible on the face of your own petition, before anyone contests anything.

Texas. Rule 510.3(a) of the Texas Rules of Civil Procedure requires the eviction petition to be sworn and to contain a description of when and how the notice to vacate was delivered. Not that notice was given — when, and by what method. A petition missing that description can usually be amended, but the court may not grant possession on a petition that never supplies it.

California. Cal. Code Civ. Proc. § 1166(a)(5) requires the complaint to "state specifically the method used to serve the defendant with the notice or notices of termination" — satisfied by completing every service-related item on the Judicial Council form complaint, or by attaching a proof of service. Subdivision (d)(1)(A) separately requires a residential plaintiff to attach a copy of the notice itself; if it is missing, the court grants a five-day window to amend. Watch the sunset clause, though: this version of § 1166 operates only until January 1, 2027, when a successor section takes over.

New York sits close behind. Under RPAPL § 711(2), the fourteen-day rent demand must be served the way the petition itself is served, under RPAPL § 735 — personal delivery, substituted service plus a dual mailing, or conspicuous-place service plus a dual mailing. The demand and its proof of service are then filed within three days. New York does not treat the rent demand as a private letter. It treats it as process.

The practical takeaway: in a Texas or California filing, "I mailed it sometime in early August" is not a gap in your evidence. It is a gap in your pleading.

What Actually Counts as Proof

Courts are not looking for one magic document. They are looking for a chain: that this notice, containing this text, left your hands on this date, by a method the statute authorizes, aimed at the right person at the right address.

DocumentWhat it establishes
Exact copy of the notice as sentContent and notice period — not a re-typed version
Mailing receipt with the article numberDate the notice entered the mail stream
Tracking history or delivery recordThird-party confirmation of what happened to it
Timestamped photo of the deliveryThat a physical document reached the location
GPS coordinates of the deliveryThat it reached this address, not an assumed one
Lease page showing the notice addressThat you sent it where the statute directs
E-mail addendum, if serving by e-mailWritten consent, where the state requires one

State-specific evidence notes

Ohio. Ohio Rev. Code § 1923.04(A) authorizes certified mail with return receipt requested, hand delivery to the defendant, or leaving the notice at the usual place of abode or at the premises. The same subsection hides an evidence trap: the notice must carry the statutory language beginning "You are being asked to leave the premises." Flawless proof of delivery of a notice missing that paragraph proves you delivered a defective notice.

Florida. Fla. Stat. § 83.56(4) permits mailing, delivering a true copy, e-mailing in accordance with § 83.505, or leaving a copy at the residence if the tenant is absent. The e-mail route carries its own paperwork — a signed addendum designating the address, and a bounce-back means delivery failed. Serve by e-mail and the addendum belongs in your file next to the notice.

Arizona. A.R.S. § 33-1313(B) defines receipt as occurring when the notice comes to the tenant's attention, is delivered in hand, or is mailed by registered or certified mail to the address the tenant holds out for receipt. Each is provable by a different artifact, and only the middle one depends on a person being home.

Georgia. O.C.G.A. § 44-7-50 requires a demand for possession but prescribes no form or method, which shifts the whole question to evidence. With no statutory checklist to satisfy, whatever record you happen to have is the standard.

Statutes are amended and local courts apply them differently. This article is general information published in September 2026, not legal advice, and EvictServe is not a law firm. Three Ways the Proof Falls Apart

The notice you cannot reproduce. Landlords who draft a notice in a word processor and overwrite the file for the next tenant arrive with a template, not an exhibit. Where the statute governs content — Ohio being the obvious case — the court needs the document as sent, dates and required language intact.

The photograph with no coordinates. A phone picture of a document on a doormat shows a document on a doormat. It does not establish which doormat, or when. Metadata helps, and is often stripped by the time the image is printed or forwarded. A record logging timestamp and GPS coordinates alongside the photo answers both questions on its face.

The green card that never came back. Certified mail with return receipt is the most commonly recommended method and the most commonly frustrated one, because it depends on the tenant signing. An unclaimed or refused article is not automatically fatal — the tracking history is itself a record, and several states measure the period from mailing rather than receipt — but a landlord who planned on a signature and got a "Return to Sender" scan is improvising. Recovery options are in what to do when a tenant won't claim the certified mail.

One scheduling point: the USPS keeps the Certified Mail delivery record, signature included, for two years from mailing. Save your copy when you have it.

The Texas Escape Hatch — and Its Limits

Tex. Prop. Code § 24.005(f-4), effective with the Senate Bill 38 rewrite on January 1, 2026, says the delivery-method list in subsection (f-3) "does not apply if the tenant actually receives the notice." Actual receipt cures a method defect.

Treat that as a safety net, not a strategy. Invoking (f-4) means proving receipt — and if your method was irregular to begin with, your proof is probably thin, which is how you ended up relying on (f-4) at all. Better to land inside one of the four authorized methods in (f-3), which our guide to hand delivering an eviction notice in Texas walks through in order.

Building a File That Survives the Hearing

Two delivery channels, run together, produce complementary records that do not depend on the same thing going right.

If your judge wants a sworn statement about service for the court file, that is a document for you or your attorney to execute — a delivery service supplies the underlying records, not testimony. Ask a licensed attorney in your jurisdiction what form it should take.

Before any of it, the notice has to be right. Our free eviction notice generator produces a state-appropriate document, our state-by-state requirements guide covers periods and content, and how to count notice days covers the arithmetic that decides whether you filed too early.

Frequently Asked Questions

Do I have to file proof that I served the eviction notice?

It depends on the state and the stage. Texas requires the sworn petition to describe when and how the notice to vacate was delivered. California requires the complaint to state the service method specifically, or to attach a proof of service, plus a copy of the notice. New York requires the predicate rent demand and its proof of service to be filed within three days. Elsewhere the proof is evidence you hold in reserve — but you still need it.

Is a certified mail receipt enough by itself?

Often yes, where the statute authorizes mail and the period runs from mailing. It is weaker when the tenant claims nothing arrived, because the receipt shows what you sent and where, not what was received. A physical delivery closes that gap.

The tenant says they never got the notice. Now what?

Your tracking history and any delivery photographs become the center of the case. In Texas, § 24.005(f-4) runs the other way too — actual receipt makes the method irrelevant, so a tenant who acknowledges the notice in a text or e-mail has undercut the argument. Preserve those messages.

Can I just testify that I delivered it?

In an uncontested case, that may be the end of it. In a contested one you are asking the court to choose between your recollection and the tenant's. Records exist so it does not have to.

Do I need a sworn statement from whoever delivered the notice?

Some courts want one for the file. That is a question for a licensed attorney in your jurisdiction, who can tell you what form is accepted locally and who should sign it. A delivery service supplies the underlying records — mailing receipt, tracking history, photo and GPS proof of delivery — that such a statement would rest on.

The Short Version

Decide what your proof will look like before you send the notice, not after the tenant disputes it. In Texas and California the delivery details go into the filing itself; in New York the demand is served and proven like process; in Georgia, with no statutory method at all, your records are the only standard there is. A dated mailing record and a photographed, GPS-logged delivery answer the two questions a court actually asks — when, and where — without needing the tenant's cooperation.
